Gov. Ron DeSantis (R-FL) responds to a court blocking his state's 15-week abortion ban. Judge John Cooper announced Thursday that Florida's 15-week abortion ban will be blocked in state court this comes on the heels of the supreme court ruling to overturn Roe v Wade last week Florida governor Ron DeSantis promised that he will appeal the ruling which will likely automatically block Cooper's ruling until another court decision can be issued take a listen for governor DeSantis's full reaction here.
You know make a couple of comments, we've had a lot of judicial activity lately but we did have a ruling in Tallahassee (Florida) effectively in joining the bill that we provided though that I signed to provide protections for unborn babies at 15 weeks and we knew that that was likely going to be what was decided in that case.
We knew that we were going to have to move forward and continue the legal battle on that and that's something that was decided under state law so was not anticipate unanticipated it was not of course something you know that we were happy to see and when you talk about these are unborn babies that have heartbeat they can feel the pain they can suck their thumb and to say that the state constitution mandates things like dismemberment abortions I just don't think that's the proper interpretation so we'll go we'll appeal, DeSantis concluded his statement.
The Florida legislature passed the law, known as House Bill 5, and Governor Ron DeSantis signed it in April. The law bans most abortions after the 15th week of pregnancy unless the health of the mother is threatened or unless the baby has a "fatal fetal abnormality," according to the Washington Post.
Leon County Circuit Judge John Cooper announced that he would issue a temporary injunction against the state abortion ban, calling it "unconstitutional." The judge did not draw on last week’s Supreme Court decision that overturned Roe v. Wade but instead referenced from the state constitution’s language regarding privacy.
